Terms of Service & Release
This Terms of Service and Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement (“Agreement”) is between you (whether a Member or Guest, referred to as “you” or “your”) and Playtime Pickleball Club, LLC (“Club,” “we,” “us”). The Club includes its owners, directors, officers, employees, agents, contractors, and their successors and assigns (“Released Parties”). “You” includes your heirs, personal representatives, beneficiaries, and assigns, and, if applicable, any minor children for whom you are legally responsible.
PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. THIS IS A BINDING LEGAL AGREEMENT. BY SIGNING, YOU WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR CERTAIN CLAIMS.
1. Agreement Overview
This Agreement governs your use of the Club’s premises (e.g., pickleball courts, restrooms, players’ lounge and parking areas), equipment (e.g., paddles, nets), and services (e.g., court reservations, lessons, tournaments, events) (“Premises and Services”), as well as participation in pickleball-related activities, including games, clinics, or leagues (“Activities”). In consideration for such use or participation, you agree to the terms herein.
2. Rules and Conduct
You agree to comply with the Club’s Policies and Rules, available at www.playtimepbclub.com or upon request at the Club’s front desk, as they exist now or may be amended. These rules ensure safe and respectful use of the Premises and Services. You also agree to follow the Code of Conduct, which includes:
- Acting with sportsmanship, fairness, and respect.
- Avoiding obscene language, gestures, or behavior that endangers others.
- Not using the Club’s name, logos, or materials for personal gain.
- Supervising minors under your care.
- Refraining from giving private lessons for a fee without written consent from Club management.
- Avoiding discrimination, harassment, or abuse.
3. Consequences of Violations
Violating this Agreement or the Policies and Rules may result in immediate suspension or termination of your membership, access to the Premises, or participation in Activities, at the Club’s discretion, without refund of membership fees, event fees, or other payments, as permitted by Washington State law.
4. Court Reservations and Cancellations
Court reservations are first-come, first-served, based on availability, and are not guaranteed. The Club may modify, cancel, or suspend reservations for events such as tournaments, private functions, or other Club programming.
Reservations must be made and cancelled exclusively through CourtReserve.com or the Playtime Pickleball Club mobile app. Cancellations must be submitted at least 24 hours in advance to avoid a late cancellation fee. Club front desk staff are available to assist with reservation changes upon request.
If a member fails to show up for a reserved court (“no-show”) or arrives more than 15 minutes after the scheduled start time without prior notice, the Club reserves the right to reassign the court or add a waitlisted player to that reservation. A no-show fee will apply.
5. Membership Cancellations, Downgrades, and Upgrades
Annual Membership Refunds – First 30 Days In accordance with Washington consumer protection laws, Members may cancel their annual membership within thirty (30) days of the membership start date by submitting a written request to info@playtimepbclub.com. If approved, any refund issued during this period will be subject to an administrative cancellation fee. In addition, all facility usage, including court reservations, programming, events, and services utilized during the membership period, will be recalculated at standard guest rates and deducted from the refund issued. Approved refunds will be processed using the original form of payment unless otherwise determined by the Club.
Annual Membership Cancellations & Downgrades – After 30 Days Cancellations or downgrades requested more than thirty (30) days after the membership start or renewal date will take effect at the end of the current annual billing cycle. No refunds, credits, or prorated amounts are due or will be issued for any portion of the membership fee after the initial thirty (30) day period. All court fees, programming, events, services, and any other usage during the membership term are non-refundable, regardless of frequency of use or participation level.
Discretionary Exceptions At the sole discretion of Playtime Pickleball Club, partial refunds or credits may be considered only in cases of exceptional circumstances, including but not limited to medical emergencies, relocation, or other significant hardships. Any discretionary refund or credit, if approved, will be subject to administrative fees and deductions for usage calculated at standard guest rates and does not establish precedent for future requests.
Annual Membership Upgrades Membership upgrades will be activated on the same day payment is received. A new annual billing cycle will begin on that date. Management will review any remaining value from the previous membership and may apply a credit to the new cycle at their discretion.
6. Health, Safety, and Assumption of Risks
The Club prioritizes your health and safety but cannot eliminate all risks. By using the Premises and Services or participating in Activities, you acknowledge and voluntarily assume all inherent risks, including but not limited to:
- Physical risks (e.g., slips, trips, collisions, falls) that may cause injuries such as fractures, sprains, concussions, or, in rare cases, death.
- Health risks (e.g., illness, dehydration, aggravation of pre-existing conditions).
- Property damage (e.g., lost or damaged personal items).
You declare that you are physically and mentally capable of participating and have no known health conditions that could jeopardize your safety or others’. You assume these risks for yourself and any minors under your care.
7. Waiver of Liability
In consideration for using the Premises and Services or participating in Activities, you, on behalf of yourself and any minors under your care, release, waive, and forever discharge the Released Parties from any claims, demands, or causes of action arising from ordinary negligence related to your use of the Premises and Services or participation in Activities, to the extent permitted by Washington State law (RCW 4.24.510). This waiver does not apply to claims arising from gross negligence, willful misconduct, or intentional acts.
8. Indemnification
To the extent permitted by Washington State law, you agree to defend, indemnify, and hold harmless the Released Parties from claims, losses, or liabilities arising from your or your minor child’s use of the Premises and Services or participation in Activities, provided such claims do not arise from the Released Parties’ gross negligence, willful misconduct, or intentional acts. This includes reasonable legal fees and costs.
9. Media Consent
You consent to the Club’s use of photographs, videos, or recordings of you or your minor child taken during Activities or on the Premises for promotional, advertising, or trade purposes, unless you opt out in writing to management. For minors, this consent is granted by the parent/guardian.
10. Communications and Privacy
You confirm that contact information provided to the Club (e.g., address, phone, email) is accurate and voluntarily given. The Club may contact you for operational or promotional purposes, subject to Washington privacy laws. Our Privacy Policy, available at www.playtimepbclub.com or the front desk, governs the handling of your personal information.
11. Governing Law
This Agreement is governed by Washington State law. Any disputes will be resolved in accordance with Washington State law, including RCW 4.24.510 for recreational activity waivers.
